Tina Rulli from UC Davis will be presenting on "Reproduction and the Equal Burden Principle." Abstract: In jurisdictions where abortion is restricted only the pregnant person bears the legal burdens of mandated gestation and labor on pains of criminal punishment. But a plausible Equal Burden Principle states that when two or more people are equally responsible for producing an outcome that incurs a legally imposed burden, they should be burdened equally. This paper assumes that abortion restrictions are justified. It then advances the argument that in places with abortion restrictions, when a pregnant person is required to gestate and give birth when they would otherwise abort, the equally responsible inseminating partner should be legally mandated to donate a kidney to save a person’s life. This argument is intended as a reductio ad absurdum of the anti-abortion position. People have a right against the state that it not interfere in bodily autonomy and integrity. For all the same reasons, abortion restrictions are unjustified.
